Terms of Use (Terms of Service)

These Terms of Use (“Terms”) are a legal agreement between you and Habib Yagiz Demir (“we,” “us,” “our”) governing your access to and use of the Plant Identifier mobile application (the “App”) and any related services (collectively, the “Service”).

If you do not agree to these Terms, do not use the App.

1) Acceptance of Terms

By downloading, installing, accessing, or using the App, you:

  • Confirm that you have read and understood these Terms; and
  • Agree to be bound by these Terms and our Privacy Policy (available via the App and/or our website).

If you are using the App on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

2) Service Description

The App is designed to help users learn about plants and identify plants from photos. Key features include:

  • Plant identification from photos (camera or photo library), returning a profile (e.g., common/botanical name, confidence score, care guidance, health assessment, facts, and FAQs).
  • AI chat (“Botanical Expert”) that answers plant-related questions based on your messages.
  • A personal collection where identified plants and their profiles can be saved on-device and may sync via Apple iCloud/CloudKit depending on your device settings.
  • Settings and onboarding flows, and optional notifications (if you enable them).

The Service uses automated systems and third-party APIs (including AI models) to generate outputs. Results may be inaccurate, incomplete, or inappropriate for your situation. See Section 9 (Disclaimers).

3) Eligibility

You must be at least:

  • 13 years old to use the App; and
  • If you are under the age of majority where you live, you may use the App only with the consent of a parent or legal guardian.

4) User Accounts & Security

The App may create or use a technical account/session (for example, an anonymous authentication session) to provide features such as AI chat and plant identification.

You agree to:

  • Use the App only for lawful purposes;
  • Keep your device secure (including any device passcode/biometrics) and prevent unauthorized access to the App; and
  • Notify us promptly at h.yagizdemir@icloud.com if you believe your access has been compromised.

We may suspend or terminate access to the Service (in whole or in part) if we reasonably believe you have violated these Terms or misused the Service.

5) Subscriptions, Purchases, and Billing (If Available)

Some features may require a paid subscription or other in-app purchase (“Paid Features”). Paid Features are processed through the Apple App Store and/or our paywall/monetization providers.

If you purchase a subscription:

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel subscriptions in your device’s App Store account settings.

Refunds: Purchases and refunds are handled by Apple under Apple’s policies. We cannot grant refunds directly unless required by applicable law.

Price Changes: Subscription pricing may change. Apple will notify you where required.

6) User-Generated Content (Photos and Messages)

The App lets you submit:

  • Photos/images (for identification); and
  • Text messages (for AI chat).

Your content remains yours. However, to operate the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to:

  • Host, store, reproduce, transmit, and process your submitted content;
  • Create derivatives as necessary for technical processing (e.g., resizing/compressing images); and
  • Use your content solely to provide, maintain, and improve the Service (including for debugging, safety, and abuse prevention).

Content rules

You agree that you will not submit content that:

  • You do not have the right to use (including copyrighted photos you do not own or lack permission to use);
  • Is unlawful, abusive, harassing, hateful, or sexually explicit;
  • Contains personal data of others without permission; or
  • Attempts to exploit or interfere with the Service (e.g., malware, prompt injection intended to break safety rules, scraping, or denial-of-service attempts).

We may remove, restrict, or block content or usage that violates these Terms or is otherwise harmful.

7) Cameras, Photo Library, and Local Storage

Depending on how you use the App, it may request access to:

  • Camera (to take a photo);
  • Photo library (to select a photo); and/or
  • Photo library write access (only if you enable an “auto-save photos” setting, where available).

The App stores certain data locally on your device, such as:

  • Saved plant profiles and related metadata; and
  • Local image files for plants you save to your collection.

If iCloud/CloudKit sync is enabled on your device, certain saved records may sync via iCloud. Image files may not sync and availability can vary by device and configuration.

8) Intellectual Property Rights

The App and Service, including all software, code, designs, text, graphics, logos, and overall look and feel, are owned by Habib Yagiz Demir or licensed to us and are protected by intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

You may not:

  • Copy, modify, distribute, sell, lease, or reverse engineer the App except as permitted by law;
  • Use the App to develop a competing product; or
  • Remove or alter proprietary notices.

9) AI Outputs; No Professional Advice

The App provides AI-generated information for educational and informational purposes only.

You acknowledge that:

  • Identifications and answers may be wrong (including confidence scores).
  • Outputs may be based on incomplete or ambiguous inputs (e.g., a blurry photo).
  • The App is not a substitute for professional advice (including scientific, wildlife, veterinary, legal, or safety advice).

Do not use the App for emergency decisions. When in doubt, consult qualified experts and follow local laws and safety guidance.

10) Third-Party Services & APIs

The Service relies on third-party services and SDKs that may process data as described in our Privacy Policy. These may include, for example:

  • Google Firebase (Authentication, Cloud Functions, Cloud Storage, Messaging/Notifications);
  • Apple services (App Store billing, iCloud/CloudKit synchronization where enabled, and system frameworks);
  • Superwall (paywall/subscription management);
  • Mixpanel (analytics/measurement); and
  • AI model providers accessed through our backend.

Third-party services are provided “as is” by their respective providers. We do not control and are not responsible for third-party services, outages, or changes that may affect the App.

11) Prohibited Uses

You agree not to:

  • Use the Service for unlawful purposes or in violation of any applicable law;
  • Interfere with or disrupt the Service, servers, or networks;
  • Attempt to gain unauthorized access to any part of the Service;
  • Circumvent paywalls or access Paid Features without authorization;
  • Use automation to send excessive requests; or
  • Use the Service to harm wildlife or violate wildlife protection rules (e.g., encouraging interference with protected nests).

12) Termination

You may stop using the App at any time. You can remove the App from your device.

We may suspend or terminate your access to the Service at any time, with or without notice, if:

  • We reasonably believe you violated these Terms;
  • Your use creates risk or legal exposure for us or others; or
  • We discontinue the Service.

13) Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free;
  • AI outputs will be accurate, complete, or reliable; or
  • Any defects will be corrected.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL HABIB YAGIZ DEMIR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

  • Your use of or inability to use the Service;
  • AI outputs, identifications, or information provided by the Service;
  • Unauthorized access to or alteration of your content; or
  • Any third-party services or content.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  • USD $10.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

15) Governing Law

These Terms are governed by the laws of [Insert Jurisdiction, e.g., Türkiye], without regard to conflict-of-law rules.

16) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as:

  • Updating the “Last Updated” date; and/or
  • Providing an in-app notice where feasible.

Your continued use of the App after updated Terms become effective means you accept the updated Terms.

17) Assignment; Transfers

You may not assign your rights or obligations under these Terms without our prior written consent.

We may assign these Terms (in whole or in part) to an affiliate or successor in connection with a merger, acquisition, asset sale, or other change of control.
